Subject:dad's dui

Mood: worried

Since I had a good holiday I figured it'd be best to post this in a separate entry so as not to spoil the rest. That probably sounds silly huh?

Turns out, my Dad's in jail. The lady from the campground where my Dad lives called my sister. He was arrested yesterday for a DUI, evade and elude, and resisting an officer w/o violence. This is his fourth DUI in the state of Florida though his last DUI was about 21 years ago according to my Mom. His bail is set at $2,500 but bond is 10% of that or $250. That's really not that much but I don't trust him to get out on bond and then follow through and show up at court and do what he needs to do, etc. If he didn't and we paid the bond, guess who'd be liable for the full $2,500? Yeah. NOT happening. I don't think he knows either of our phone numbers without his phone so at least we don't have to worry about him calling us and making us feel worse than we already do about our decision to leave him there. Sentencing is on 1/11.

So, I'm looking up FL DUI laws and I wish I hadn't. This is his 4th DUI in the state of FL, though his last DUI was 21 years ago. Here's what I've found for 4th convictions:

DUI Felony Conviction: (Repeat Offenders or Accidents Involving Serious Bodily Injury)-s. 316.193 (2),(3) F.S.
Any person convicted of a third DUI within 10 years or a fourth or subsequent DUI commits a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment).

Imprisonment- s. 316.193 (2)(a) 2, 4(b), (6)(j), F.S.
Fourth or Subsequent Conviction: Not more than 5 years or as provided in s.775.084, Florida Statutes, as habitual/violent offender.

Driver License Revocation Periods for DUI-s. 322.271, F.S. and s. 322.28,F.S.
D. Fourth Conviction, Regardless of When Prior Convictions Occurred) and Murder with Motor Vehicle: Mandatory permanent revocation. No hardship reinstatement.

Those are all maximum sentences of course except for the DL revocation. He's SOL on that. And I don't have any idea how he'll get around without a license or without a vehicle for that matter. I'm sure they impounded his truck and even if by some miracle we could afford to get it out, what's the point? He can't legally drive anyways.

You can always count on my dad to figure out a way to make an already shitty situation ten times worse for himself. Just when you think he's hit rock bottom, he figures out a way to put himself even lower.

I called the jail and gave them my name and contact information for next of kin. He almost died of alcohol withdrawals earlier this year and if he's in jail without anything to drink, it's likely he'll go through the detox again so if he ends up in the hospital, I want to know. I let them know that he'd tried to kill himself earlier this year and about the alcohol withdrawals so they'd know to keep an eye on him and his health. They said that they already have him in 24 hour observation because he made a comment to them about how he'd tried to kill himself earlier this year.

So yeah, that's that.
